CHAPTER 9.

AN ACT entitled an act to incorporate Irving
College, in Manchester, Car roll county.
WHEREAS, Ferdinand Diffenback, John H. Fal-
coner, John W. Horn and Henry B. Roemer,
have set forth to this General Assembly that
they have been for some time associated for the
education of youth, the pursuit of science and
the general diffusion of knowledge, and have
prayed to be incorporated :

SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That Ferdinand Diffenbach,
John H. Falconer, John W. Horn and Henry B.
Roemer, and those who . may hereafter become
members of said association, and their successors,
after the passage of this act, be and they are here-
by created and declared to be a body corporate
and politic, by the name and style of Irving Col-
lege, and by that name to have succession, and
be capable at law and equity to sue and be sued,
plead and be impleaded in any court or courts,
and before any judge or justice or justices in this
State or elsewhere; and it shall and may be lawful
for said corporation and their successors, to de-
vise, make, have and use a common seal, and the
same to break and alter at pleasure.

Proviso.
|
SEC. 2. And be it enacted, That the said cor-
poration and their successors, by the name and
style aforesaid, shall be capable in law to pur-
chase, take and hold any real and personal estate,
and to sell, lease or dispose of the same, either
absolutely or upon condition; Provided, That the
said association shall not at any one time hold
and possess more than fifty acres of land, and
that the net annual value of said real and per-
sonal estate, exclusive of the buildings and ap-
partments appropriated for the use of the students
and professors of said college, shall not exceed the
sum of ten thousand dollars.

SEC. 3. And be it enacted, That the members
of said corporation may assemble as soon as con-
venient after the passage of this act, and make,
ordain and pass such ordinances and by-laws,
not contrary to the constitution and laws of this
