SEC. 1. Be it enacted by the General Assembly of
Maryland, That so much of the first section of said
act as names the trustees to make sale of said road,

be and the same is hereby repealed; Provided, That
said repeal shall not be construed to exempt said
trustees, or those who may have been appointed in
pursuance of the second section of said act, from any
responsibility for acts already done, and monies col-
lected or contracted for in the last sale of said road,
nor the purchaser of said road from the full payment
of the purchase money.

Proviso.

SEC. 2. And be it enacted, That James Dixon Ro-
man, Thomas Harbine, and Leander McKee, be and
they are hereby appointed trustees in the place and
stead of those heretofore appointed, with full power
and authority to resell, transfer and convey all that
portion of said road lying in the State of Maryland,
together with its appurtenances, and all the cor-
porate rights, privileges, powers and franchises be-
longing to the Franklin Rail Road Company, and in
all respects in the manner, form and effect as pre-

scribed in said act; Provided, That said sale shall al-
ways be subject to the conditions and provisions con-
tained in the fifth section of said act, and upon this
further condition, that the purchaser or purchasers of
said road shall, within sixty days after the ratifica-
tion of the sale, bona fide, commence the re-laying of
said road, and within four months from such ratifi-
cation, shall have at least one mile thereof re-laid in
the manner contemplated in the fifth section of said
act; for the faithful performance of which said last
mentioned condition, the purchaser or purchasers
shall give bond to the trustees, with security to be
by them approved, in the penalty of one thousand
dollars, conditioned that it be forfeited upon the fail-
ure or neglect of the purchaser or purchasers so to
commence and relay at least one mile of said road
within the times and manner aforesaid, and upon the
failure of the purchaser or purchasers to comply with
said last named condition, and the conditions of the
fifth section of said act, or any of them, the trustees
shall declare said sale forfeited, and shall proceed to
re-sell the same, subject to the same terms, condi-
tions and provisos, and taking bond as aforesaid for
the same sum, with like conditions, and so on suc-
cessively, until such purchaser or purchasers shall re-
lay and equip the said road in the manner contem-
plated by the act to which this is a supplement ;
