ry, hardware, drugs or medicines, paints, printed
books , stationery, saddlery, gold, silver or plated
ware, jewelry, toys, wearing apparel, salted provisions
or fresh provisions, grain, meal, flour, timber, tobac-
co, cotton, leather, hides, lime, wrought or cast iron,
copper or tin, spirituous or fermented liquors in
quantities not less than a pint, or any other kind of
goods, wares or merchandise, foreign or domestic,
without first obtaining a license, in the manner pre-

scribed by this act; Provided, persons carrying on shad
and herring fisheries, in this State, may sell and dis-
pose of so much salt as may be necessary to cure the
fish purchased of them, during the months of March,
April and May, and no longer, without license, and
provided also, that nothing herein contained shall be
construed to extend to vendors of cakes, or to the
vendors of beer or cider, who are the makers of such
beer or cider; or to females engaged in vending mil-
linery or other small articles of merchandise, whose
stock in trade does not exceed five hundred dollars;
provided nevertheless, nothing here contained shall be
construed to exempt the establishment of lager beer
or the vendors thereof.

Duty of Comp-
troller.

SEC. 2. And be it enacted, That it shall be the
duty of the Comptroller to cause to be prepared and
distributed, licenses answering to the provisions of
this act, according to the directions of an act enti-
tled an act for the greater security of the revenue from
licenses in the hands of the clerks of the several
Courts of this State, passed January session eighteen
hundred and fifty-two.

SEC. 3. And be it enacted, That where any per-
son or persons, body or bodies corporate, shall de-
sire and purpose to sell or barter any of the articles,
goods, wares, or merchandise enumerated or mention-
ed in the first section of this act, it shall be the duty of
such person or persons, body or bodies corporate, to
apply to the clerk of the circuit court of the county in
in which the applicant may reside; or if the applicant
reside in the city of Baltimore, then to the clerk of the
Court of Common Pleas of Baltimore, for a license
therefor; and upon such application, the said applicant
shall state to said clerk, on oath or affirmation to be
by said clerk administered, the amount of said ap-
plicant's stock of goods, wares, and merchandise,
generally kept on hand by him or the concern in
which he .is engaged, at the principal season of sale;
or if said applicant shall not have been previously
