LAWS OF MARYLAND.

bridge or bridges be reported as proper and expedient
to be built or repaired, then the said several county
commissioners shall direct the said examiners to ad-
vertise for sealed proposals to build or repair, as the
case may be, such bridge or bridges, as in their re-
port may be mentioned, stating the place, plan, ma-
terial and workmanship, with sufficient certainty for
the purpose of obtaining proper proposals for the
same, and also the place and time such sealed propo-
sals will be opened; and at the place so advertised,
the said examiners shall meet and open said propo-
sals, and shall award the work to the lowest bidder,
all things being considered, who shall thereupon en-
ter into a contract with said examiners, and give
bond, with security, to be by them approved, under
a penalty double the amount of the price of the
work, for the faithful performance of said work in
the said contract mentioned; and the said examiners,
during the progress of the work, and up to its com-
pletion, shall at any time have full authority to exam-
ine and direct the same, and when completed, receive
the same and open it for public use, and notify the
commissioners of their respective counties thereof; and
the county commissioners aforesaid shall, thereupon,
pay, or cause to be paid or levy for their respective
proportions of the cost of the said work according to
the contract.

Arbitration.

SEC. 7. And be it enacted, That in case the exami-
ners, on the part of adjoining counties, cannot agree
as to the relative amount each county shall pay of the
costs and expenses of building or repairing any
bridge or bridges, then the said examiners, or a ma-
jority of them, on the part of each county, shall each
appoint an arbitrator to determine the matter in dis-
pute; and in case the arbitrators cannot agree, they
shall appoint an umpire, who shall not be a resident
of either county, and the award and determination of
of the arbitrators or umpire shall be final and conclu-
sive in the matter submitted.

SEC. 8. And be it enacted, That nothing in this
act shall be construed to authorise any county com-
missioners to build, or order to be built, any draw-
bridge or bridges, or any bridge or bridges, across
navigable rivers or waters.

May appeal.

SEC. 9. And be it enacted, That in all cases, upon
representation in writing, of any citizen or citizens of
any county in which the county commissioners may, un-
der this act, determine to build or repair any bridge
