dict of the jury and recorded, but if the said inqui-
sition should be set aside the said court may in its
discretion as often as may be necessary, direct anoth-

er inquisition in the manner above described.

SEC. 7. And be it enacted, That the said com-
pany shall cause the said road to be laid out, at least

thirty feet wide, sixteen feet whereof in breadth at
least shall be made an artificial road, to be composed
of gravel or stone; and shall for ever thereafter, dur-
ing the continuance of said corporation, maintain and
keep the same in good repair, and when three miles
of the said road shall have been completed, in the
manner aforesaid, it shall and may be lawful for
the said company to erect a toll gate thereon, and
charge and receive such tolls as are now charged
and received by the Baltimore and York Turnpike
Company, or as are prescribed by this act of incor-
poration in regard to tolls, &c.

SEC. 8. And be it enacted, That the stockholders
of said company in general meeting assembled or a
majority of them shall have power to make and adopt
such by-laws, rules and regulations for the direction
and management of said company as may in their
judgment be necessary for the purposes of their in-
corporation not inconsistent with the provisions of
this charter and the laws and constitution of this State,
and the president and directors of said company or
a majority of them shall constitute, appoint and em-
ploy such officers, agents and servants for the con-
struction repair and preservation of said road, and
for the receipt and collection of tolls, and transact-
ing all other business of sale as the company in their
judgment may deem necessary.

Management.

SEC. 9. And be it enacted, That nothing in this
act contained shall be so construed as to authorise
said company or its agents or officers to issue any
scrip or bank note or exercise any banking privi-
leges.

SEC. 10. And be it enacted, That this act shall
take effect from the day of its passage.
