AN ACT to prevent the introduction into this State
of fraudulent Lotteries and Lottery Tickets.
|
|
|
Penalty.
|
SECTION I. Be it enacted by the General Assem-
bly of Maryland, That any person printing or pro-
curing to be printed within this State, bringing or
sending or procuring to be brought or sent into this
State, any scheme or schemes of any pretended or fic-
titious lottery or any pretended drawing or drawings of
any such scheme or schemes, or any ticket or part of a
ticket or certificate of, or substitute for any ticket or
tickets, or part or parts of a ticket or tickets in any
such pretended or fictitious lottery, shall upon in-
dictment therefor, and conviction thereof be punish-
ed by a fine of not more than one thousand dollars
and costs and imprisonment for twelve months; and
on the trial of any indictment under this section any
lottery scheme, drawing, ticket, certificate of, or sub-
stitute for a ticket or tickets, which shall be proved
to have been by the traverser or traversers, printed or
procured to be printed within this State, or brought
or sent or procured to be brought, or sent into this
State, shall be held to be prima facie evidence of
such act, within the description of this section, un-
less upon the face thereof, it shall be made to appear
by what State or Territory or Government, such
lottery shall be authorised, together with the title of
the act authorizing the same, and the year when same
was passed and the chapter and number of such
act.

SEC. 2. And be it enacted, That if any person or
persons shall print or procure to be printed within
this State, or bring or send or procure to be sent or
brought into this State, any scheme, drawing, ticket,
part of a ticket or certificate of or substitute for any
ticket in any pretended or fictitious lottery, which shall
upon the face thereof, or otherwise be falsely repre-
sented to be authorized by any State or Territory, or
by the Congress of the United States, or by any
other government, he shall upon indictment therefor,
and conviction thereof be punished by a fine of not
more than one thousand dollars and the costs of suit
and imprisonment for not more than two years.

SEC. 3. And be it enacted, That nothing in this
act shall be construed to apply to schemes, drawing
|
