their farm to another part thereof, shall be chargea-
ble with tolls.

SEC. 18. And be it enacted, That nothing herein
contained shall be construed to authorize said com-
pany to exercise banking privileges; and the legisla-
ture reserves the right to amend, alter or repeal this
act at pleasure.

take effect from and after the day of its passage.

CHAPTER 25.

In force.

AN ACT to authorize and direct the sale of certain
lands devised to Lawrence W. Bates and Eliza, his
wife, as Trustees by Elizabeth Bayley, deceased, and
the investment of the proceeds thereof in other prop-
erty for the same purposes.

WHEREAS, it has been represented to the General As-
sembly of Maryland, That certain lands lying and be-
ing in Somerset county, in this State, were devised by
a certain Elizabeth Bayley to Lawrence W. Bates and
Eliza his wife, to have and to hold the same in trust
for the use and benefit of a certain Thomas H. Bay-
ley during his life, and of the lawful heirs of said Bayley
if any should be living at the time of his death; and in
the event of the death of said Bayley without such law-
ful heirs living, then the said lands are devised to her
two daughters Rebecca and Eliza, and their heirs as
tenants in common; and whereas, it has been further
represented that it would be greatly to the interest and
advantage of all persons interested in said devise to
have the said lands sold and the proceeds thereof in-
vested in other real estate, or in some productive fund;
therefore;

Preamble.

SECTION 1. Be it enacted by the General Assembly of
Maryland, That the Circuit Judge of the eighth judicial
circuit of Maryland sitting in equity, shall have full power
and authority, upon the application of the trustees named
in the will of Elizabeth Bayley, late of Worcester coun-
