CHAPTER 193.

AN ACT relating to Fines, Forfeitures, and Pen-
alties.

Duty of jus-
tices of the
peace.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That it shall be the duty of every jus-
tice of the peace, of the State of Maryland, in and
for the city of Baltimore, to file with the Clerk of the
Court of Common Pleas for Baltimore city, within
thirty days after the first Monday of September, and
on the 1st day of April in each and every year, un-
der his oath or affirmation, a list and account of all
fines, forfeitures, and penalties under the laws of this
State by him imposed within the twelve months then
next preceding such first Monday of September, dis-
tinctly showing which and what amount of said fines,
forfeitures, and penalties have been paid in each case;
and it shall be also his duty, at the time of his filing
such list and account to pay over to the said Clerk
all such fines, forfeitures and penalties, or parts there-
of, to which the State of Maryland is entitled; and
the said Clerk shall account for the same as for oth-
er public moneys by him received.

To make affi-
davit.

SEC. 2. And be it enacted, That if any such jus-
tice shall not have imposed or received any such fines,
forfeitures or penalties within such twelve months,
it shall be his duty, within such thirty days after the
first Monday of September, and on the first day of
April, in each and every year, to file with such Clerk
an affidavit to that effect.

Liable to in-
dictment.

SEC. 3. And be it enacted, That if any such jus-
tice of the peace shall neglect or refuse to comply
with the provision of this act, or shall file with such
Clerk any false or incomplete list and account or af-
fidavit of, or concern ing such fines, forfeitures and
penalties as aforesaid, he shall be liable to indictment,
and on conviction shall be subject to a fine not ex-
ceeding five hundred dollars.
