CHAPTER 179.
|
|
|
|
AN ACT to authorise the Orphans' Court for Balti-
more county to order a sale of part of the real es-
tate in said county, of which Robert Turner, late
of said county, died, seized.
|

WHEREAS, some of the heirs-at-law and devisees of
of Robert Turner, late of Baltimore county, de-
ceased, by their petition to the Legislature have
represented that said Robert Turner, by his last
will and testament admitted to probate in the Or.
phans' Court for Baltimore county, on the 7lh
June, eighteen hundred and thirty-seven, directed
that when his plantation should be sold, that his
executrix should reserve the burying ground; and
that it was so reserved, but that certain of the
streets and avenues of Baltimore city are contem-
plated to be extended, which, when done, will be
laid out over and through said burying ground; and
in view thereof have prayed an act of Assembly
to authorise the Orphans' Court to order a sale of
said reserved lot; therefore,

Preamble.

SECTION. 1. Be it enacted by the General Assem-
bly of Maryland, That the Orphans' Court for Bal-
timore county be authorised, upon the application of
one or more of the heirs-at-law of Robert Turner,
late of Baltimore county, deceased, to order a sale
to be made (by the executrix appointed in said will
of Robert Turner, or in case of her death or refusal
to act, to appoint some other person so to do,) of the
lot of ground in Baltimore county, part of the plant-
tation of Robert Turner, reserved as the burying

ground in the will of said Robert Turner; Provided,
that before passing said order, the said Orphans'
Court require the parties so applying for such order,
to cause notice by publication in two newspapers,
published in the city of Baltimore, for the space of
six weeks, giving one insertion a week, of their in-
tention to apply for such order at the expiration of
three months from the date of such advertisement,
and warning all persons interested to show cause, if
any they have, why such order should not be passed
by the said court; upon the expiration of which said
three months, if no good and valid reason be shown
to the Orphans' Court for Baltimore, why said bury-
ing ground lot should not be sold; then in such case
