said, and to provide for assessing and levying on the
properly of persons benefitted within the same limits,
the expenses which may be incurred in the grading
or paving, or both, of said North Avenue, or any
part thereof, us aforesaid, in the same mariner as is
now provided by existing laws and ordinances for the
grading and paving of streets in the city of Balti-
more.

Divide into

sections.

SEC. 2. And be it enacted, That before the Mayor
and City Council of Baltimore shall proceed to grade
or pave that portion of North Avenue lying between
the Northern Central Railroad and Pennsylvania
Avenue, they shall divide the same into sections, as
near as may be, not less than five, and shall advertise,
as is now provided by existing laws and ordinances
in similar cases, in reference to grading and paving
streets in the city of Baltimore, for proposals for gra-
ding or paving, or both as the case may be, of each
of said sections; and the contracts shall be awarded
to the persons offering to perform the work proposed
for, for the least sum of money, if he shall give good
and sufficient security for the same; Provided how-
ever, that the same division into sections shall not
apply to the cost of executing said work, which shall
be levied generally from Pennsylvania Avenue to the
Northern Central Railroad.

Assessment.

SEC. 3. And be it enacted, That any assessment
levied or charged upon the property along the line of
said Avenue, which is designated on Poppleton's
Plat of said city as the bed of a street, shall be paid
by the city of Baltimore, provided the owner or own-
ers thereof shall convey not less than one square of
the said street to said corporation within thirty days
alter said assessment shall have been made, by a
good and sufficient deed in fee for that purpose.

Right of ap-
peal.

SEC. 4. And be it enacted, That the same right of
appeal from any assessment of benefit or damage for
the grading or paving of said Avenue, to the Crimi-
nal Court for Baltimore City, or Circuit Court of
Baltimore county, shall be grunted to any owner or
owners of property aforesaid, under this act, as is
now provided under existing laws for appeals within
the city of Baltimore, or in Baltimore county, in sim-
ilar cases.

In force.

SEC. 5. And be it enacted, That this act shall take
effect from and immediately after its passage.
