(c) The public duties of a common carrier shall not be imposed
on any person with respect to any vehicle for which a permit is
required under this section, if the vehicle is not actually engaged in
public transportation.

S2. (Standards for Issuing Permits.)

(a)  No motor carrier permit shall be issued unless the commis-
sion, after considering the number of vehicles to be used, the rate
to be charged, potential demand, qualifications of the a/pplicant and
such other factors as it deems relevant, deems that the issuance of
a permit will be best for the public welfare and convenience.

(b)  In case of application by carriers of flammables, no permit
shall be issued unless in addition to requirements of subsection (a)
of. this section, the applicant has complied with all safety require-
ments prescribed by the commission and with the insurance or bond
requirements of Section 40 of this Article. Section 40 shall be fully
applicable to such carriage, except that the required notice for can-
cellation or revocation shall be 30 days.

SS. (Duration and Character of Permits.)

(a)  Except as otherwise specifically provided in this section, a
motor carrier permit may be made subject by the commission to
such terms and conditions as are deemed advisable, and shall be for
such duration, not exceeding twenty years, as the commission may
prescribe. Seasonal permits for a portion of the year are specifically
authorized in the discretion of the commission.

(b)  Permits under this sub-title may be authorized for a (period
of twenty-five years to any applicant directly furnishing, or a sub-
sidiary of a company directly furnishing, mass transportation in
any incorporated municipality by electric trolley cars, where the
applicant intends to operate motor vehicles (other than taxicabs) as
an integrated supplement to trolley service.

(c)   Where motor vehicles are to be used in substitution for the
whole or any part of electric trolley service under a franchise, ease-
ment or right of way which is longer than twenty-five years, the
commission may authorize a permit, if the owner of the franchise
or other right is willing to surrender it, to last for the duration of
the franchise or other right.

(d)  Except for permits issued under the authority of subsections
(b) and (c) of this section, no motor carrier permit to operate
upon the streets of Baltimore City shall be for more than one year.

(e)  Motor carrier permits shall be subject to suspension or revo-
cation and subsequent denial for such period as the commission may
determine for violation of any of the provisions of this Article.

(f)   Upon suspension or revocation of a permit by the commis-
sion, all certificates of registration issued by the Commissioner of
Motor Vehicles to the owner of the vehicle for which the permit was
granted shall be likewise suspended or revoked, as the case may be.

34. (Routes and Schedules.)

(a) No route or schedule of a motor vehicle for which a motor
carrier permit is granted shall be changed or abandoned while the
