extent provided in the contract; transportation of persons injured
in accidents or wrecks, and physicians and nurses attending such
persons, and other necessary caretakers in transit; transportation
of children under five years of age free of charge, and children under
twelve years of age for half fare; any transportation free, or at
reduced rates, otherwise authorized by law; issuance of mileage,
excursion, school commutation or commutation passenger tickets, or
joint interchangeable mileage tickets, with special provisions as to
the amount of free baggage that may be carried under mileage tickets
of one hundred miles or more.
(5) To free steamboat excursion transportation during May, June,
July and August of every year, from Baltimore City to any place in
this State, in exchange for services rendered in advertising said
excursion business.
26. (Rates and Charges.)
(a) No public service company shall in its utility operations:
(1) sell or render service or furnish any commodity until its
schedules of rates therefor have been duly filed and published in
accordance with section 27 (a) of this article.
(2) demand or collect a greater or less compensation for any
service or commodity than specified therefor in its schedules as in
force at the time,
(3) demand or collect any charge which for any reason violates
any of the provisions of this article,
(4) assist, suffer or permit any of the things prohibited by this
section to be done by any means or device, including but not limited
to false billing, false classification, false weighing, or false report
of weight.
(b) No person shall accomplish or seek to accomplish any of the
things prohibited by the preceding subparagraph, whether with or
without the connivance or consent of the public service company or
any of its personnel.
(c) Unless the commission otherwise orders, no public service
company shall establish any new rate or make any change in any rate
except after thirty days notice, to the commission, and publication,
in accordance with section 27 (a) of this article, during all of said
period by means of new schedules or plainly indicated amendments
upon the schedules in force and posted, which shall plainly set forth
the changes proposed to be made in the schedules then in force and
the time when the change in rate is to go into effect.
Affirmative Duties
27. (Affirmative Duties.)
Every public service company shall, in addition to such other duties
as may be specifically imposed by this Article:
(a) File with the commission a tariff schedule of its rates and
charges. Copies of such schedules shall be plainly printed, shall be
open to public inspection, and shall be posted in such manner as to
be readily accessible to and conveniently inspected by the public, as
may be ordered by the commission.
