amendments and additions to said Article 78, and to enact a new-
Article 78 in lieu thereof, said new Article to stand in the place
and stead of the Article so repealed, completely revising the laws
relating to the Public Service Commission of Maryland and relat-
ing generally to the said Commission, its powers and duties and
to the regulation of certain public utilities in this State.
SECTION 1. Be it enacted by the General Assembly of Maryland,
That Article 78 of the Annotated Code of Maryland (1951 Edition
and 1954 Supplement) be and it is hereby repealed, and that any
and all amendments and additions to said Article 78 be and they
are hereby repealed, and that a new Article 78 be and it is hereby
enacted in lieu thereof, said new Article to stand in the place and
stead of the Article so repealed, and to read as follows:
ARTICLE 78
SUB-TITLE I—SCOPE OF ARTICLE AND DEFINITIONS
1. (Scope of Article.)
The jurisdiction and powers of the Public Service Commission
shall extend to all public service companies, as hereinafter defined,
engaged in or operating a utility business in this State, and to cer-
tain additional motor carriers, as hereinafter provided, to the full
extent permitted by the Constitution and laws of the United States.
The powers of the commission shall be liberally construed; and the
commission shall have the powers specifically conferred by this
Article and by any other law, and also all implied and incidental
powers necessary and proper to carry out effectually the provisions
of this Article.
2. (Definitions.)
(a) The following terms, and such variants thereof as may be due
to requirements of grammar and syntax, when used in this Article,
shall be construed, unless the context clearly otherwise requires, in
accordance with the following definitions:
(b) (Carriers of Flammables.)
"Carriers of flammables" means (1) any motor vehicle common
carrier which transports in bulk, in tank vehicles, any liquid which
will give off flammable vapors at or below 250 degrees fahrenheit,
or any liquid which, when mixed with wood, sawdust, rags or similar
organic substances, cause spontaneous heating and ignition; and (2)
any private motor vehicle carrier whose principal business consists
of such transportation of such liquids (except where the carrier is
the owner of the cargo and the carriage is for the purpose of sale or
in furtherance of a commercial enterprise to which such carriage is
incidental).
(c) (Commission.)
"Commission" means the Public Service Commission.
(d) (Common Carrier.)
"Common Carrier" means and includes any person engaged in the
public transportation for hire of persons, property or freight,
whether by land, water, air or any combination of them, and in-
