CHAPTER 47
(Senate Bill 40)
AN ACT to repeal and re-enact, with amendments, Section 48 of
Article 54 of the Annotated Code of Maryland (1951 Edition),
title "Land Office", sub-title "Commissioner—His Powers and
Duties", correcting an error in the cross reference to two other
sections in said Article 54.
WHEREAS, by Chapter 129 of the Acts of the General Assembly
of Maryland of 1862, three sections were added to the Code of
Public General Laws of this State, these sections now being codi-
fied as Sections 45, 46 and 48 of Article 54 in the 1951 Code; and
WHEREAS, in the original version of what is now Section 48, there
was a cross reference to "the two sections next preceding this
section"; and
WHEREAS, as a part of codifying this Section 48, the reference to
"the two sections next preceding this section" was changed, in order
to refer to Sections 46 and 47 of Article 54; and
WHEREAS, by Chapter 713 of the Acts of 1941, a new section was
inserted in this sequence, so that the present cross reference in
Section 48 to Sections 46 and 47 should be changed to a cross refer-
ence to Sections 45 and 46; therefore
SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 48 of Article 54 of the Annotated Code of Maryland
(1951 Edition), title "Land Office", sub-title "Commissioner—His
Powers and Duties", be and it is hereby repealed and re-enacted,
with amendments, to read as follows:
48. No patent hereafter issued out of the land office shall
impair or affect the rights of riparian proprietors, as explained and
declared in Sections [46 and 47] 45 and i6: and no patent shall
hereafter issue for land covered by navigable waters.
SEC. 2. And be it further enacted, That this Act shall take effect
June 1, 1955.
