title "Alcoholic Beverages", sub-title "Restrictions Upon Licensees",
including Queen Anne's County in certain restrictions on sales of
alcoholic beverages by licensees under the alcoholic beverage laws.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That Section 115 (b) of Article 2B of the Annotated Code of Mary-
land (1951 Edition), title "Alcoholic Beverages", sub-title "Restric-
tions Upon Licensees", be and it is hereby repealed and re-enacted,
with amendments, to read as follows:

115.

(b) (Applicability.) This section shall apply only to Allegany,
Carroll, Charles, Harford, Queen Anne's and Washington Counties.
Provided, that in Allegany County the penalty for a violation thereof
shall be a fine not in excess of One Thousand Dollars, or confinement
in the county jail or House of Correction for a period not to exceed
two years, or both fine and imprisonment in the discretion of the
Court.

SEC. 2. And be it further enacted, That this Act shall take effect
June 1, 1955.

(Senate Bill 335)

AN ACT to add new Section 37 to Article 2B of the Annotated Code
of Maryland (1951 Edition and 1954 Supplement), title "Alco-
holic Beverages", sub-title "Local Licenses and License Provi-
sions", to follow immediately after Section 36 thereof, relating to
the definition of the word "restaurant" in Queen Anne's County.

SECTION 1. Be it enacted by the General Assembly of Maryland,
That a new section be and it is hereby added to Article 2B of the
Annotated Code of Maryland (1951 Edition and 1954 Supplement),
title "Alcoholic Beverages", sub-title "Local Licenses and License
Provisions", to be known as Section 37, to follow immediately after
Section 36 thereof, and to read as follows:

37. The word "restaurant" as used in Section 9 of this Article,
when applied to Queen Anne's County, shall mean a business estab-
lishment for the accommodation of the public, fully equipped with
a proper and adequate dining room and with sufficient facilities for
preparing and serving meals, which has been approved by the
Board of License Commissioners of Queen Anne's County, wherein
the average daily receipts from the sale of food comprise at least
sixty per centum of the average daily receipts of the said business.
