CHAPTER 14
(Senate Bill 54)

AN ACT to add sub-section (h-1) to Section 250 of Article 93 of
the Annotated Code of Maryland (1951 Edition), title "Testa-
mentary Law", sub-title "Orphans' Court", said new sub-section
to follow immediately after sub-section (h) thereof; to repeal
sub-section (j) of said Section 250 and to enact a new sub-section
(j) in lieu thereof, said new sub-section to stand in the place
and stead of the sub-section so repealed, correcting an inadvertent
error enacted by Chapter 636 of the Acts of 1951 whereby the
compensation of the Judges of the Orphans' Court of Allegany
County was purported to be reduced; restoring said compensa-
tion to the same amount as before the inadvertent change and
providing for an allowance of annual traveling expenses for each
Judge of the Orphans' Court of Allegany County.

WHEREAS, Chapter 636 of the Acts of 1951 amended what is now
Section 250 (j) of Article 93 of the Annotated Code in order to
change the compensation of the Judges of the Orphans' Court of
Baltimore County; and

WHEREAS, the title of this Act makes it very clear that its sole
intention in this respect was to affect the compensation of the
Orphans' Court for Baltimore County; and

WHEREAS, despite the fact that nothing in the title mentions the
members of the Orphans' Court of Allegany County, the body of
the law inadvertently purports to reduce the compensation of the
Judges of the Orphans' Court for Allegany County; and

WHEREAS, the Circuit Court for Allegany County has declared in
a formal opinion that the Act of 1951 is invalid insofar as it pur-
ports to change the compensation of the Judges of the Orphans'
Court of Allegany County, holding that the compensation of said
Judges has not in fact been reduced; and

WHEREAS, it is desirable to re-enact the provisions of the Act of
1951 in order that the law of the State may be in accordance with
the clear intent, both of the General Assembly and of the Circuit
Court for Allegany County; now therefore

SECTION 1. Be it enacted by the General Assembly of Maryland,
That sub-section (h-1) be and it is hereby added to Section 250 of
Article 93 of the Annotated Code of Maryland (1951 Edition), title
"Testamentary Law", sub-title "Orphans' Court", said new sub-
section to follow immediately after sub-section (h) thereof; that
sub-section (j) of said Section 250 be and it is hereby repealed and
that a new sub-section (j) be and it is hereby enacted in lieu
thereof, said new sub-section to stand in the place and stead of the
sub-section so repealed, and all to read as follows:
