as is provided in Article 26, sub-title "Judge for Juvenile Causes in
Montgomery County", enacted herewith.
(b) Whenever any minor under eighteen (18) years of age is
committed by [the magistrate for juvenile causes for] such Judge
of People's Court of Montgomery County, after trial or hearing, to
a suitable place of detention within said county, such detention there-
in shall be temporary only for such period of time as may be neces-
sary until such minor is removed or transferred to a State Institution.
TRIAL MAGISTRATES SYSTEM
92 A. (Montgomery County.) (a) As of May 1, 1955, the County
Council for Montgomery County shall appoint three Judges of the
People's Court of Montgomery County who shall meet the qualifica-
tions provided in this Article and who shall serve until the first day
of May in the year 1968 or until their successors are appointed and
qualified. As of the first day of May, 1968, and as of the first day
of May in every eighth year thereafter, the County Council of Mont-
gomery County shall appoint three Judges of the People's Court of
Montgomery County to fill the positions then expiring. One of such
judges shall be designated as the People's Court Judge for Juvenile
Causes, ; ONE OF THE JUDGES OF THE PEOPLE'S COURT
HANDLING CRIMINAL, CIVIL, AND TRAFFIC CASES SHALL
BE DESIGNATED ADMINISTRATIVE OFFICER FOR THE TWO
COURTS, THE COMMITTING MAGISTRATES AND OTHER
PERSONNEL.
(b) No person shall be qualified to hold the office of Judge of the
People's Court of Montgomery County unless he possesses the follow-
ing qualifications:
(1) He is at least thirty (80) years of age, and
(2) A member of the Bar of the State of Maryland and an active
practitioner in Maryland for at least five (5) years, and
(8) A resident of Montgomery County continuously for at least
five (5) years.
(c) Whenever a vacancy shall occur on said Court from any cause,
the County Council of Montgomery County shall appoint a qualified
person, who shall hold office as Judge for the balance of the un-
expired term to which he has been appointed or until his successor
shall be appointed and qualifies.
(d) As of May 1, 1955, the County Council of Montgomery County
shall appoint a substitute Judge of the People's Court for Mont-
gomery County. Such appointee shall serve as such until the first
day of May in the year 1958, or until his successor is appointed and
qualifies. Thereafter, as of May 1 every four years the County
Council of Montgomery County shall appoint a substitute Judge of
the People's Court to fill the term then expiring, which appointee
shall serve for four years dating from May 1 of the year of appoint-
ment or until his successor is appointed and qualifies. The provisions
of Subsection (b) of this Section, prescribing qualifications for the
Judges of said Court, shall apply to any person appointed as substi-
tute Judge. The substitute Judge shall be paid and have such duties
as hereinafter provided.
