LAWS OF MARYLAND, Nov. SESS, 1812.

1812.

ten inches shall roll more than fifteen inches, three
cents for every horse drawing the same; for every
cart or waggon the breadth of whose wheels shall be
more than twelve inches, two cents for every horse
drawing the same; and ail carriages aforesaid which
shall be drawn by oxen in the whole, or in part, or by
mules; two oxen shall be estimated as equal to one
horse, and every mule as equal to one horse, in charg-
ing all the tolls as aforesaid.

Scales may
be erected to
ascertain the
weights drawn
on said road.

17. AND BE IT ENACTED, That for the pur-
pose of ascertaining the weight which may be drawn
along the said road in any cart, waggon or carriage
of burthen, it shall and may be lawful for the said
president, managers and company, to erect and estab-
lish scales and weights, at or near so many of the
gates erected or to be erected, in pursuance of this
act as they may think proper; and where there may
seem reasonable cause to suspect that any cart, wag-
gon or other carriage of burthen, carries a greater
weight than is or shall be by law allowed, it shall be
lawful for their toll-gatherers, or other persons in
their service and employment, to prevent the same
from passing such gate or turnpike, until such cart,
waggon or carriage of burthen, shall be drawn into
the said erected scales, at or near any such gate or
turnpike, and the weight or burthen drawn thereon
ascertained by weighing; and if the person or per-
sons driving or having care or charge of any such
cart, waggon or other carnage of burthen, shall re-
fuse to drive the same into any such scales for the
purpose aforesaid, the person or persons so refusing,
shall forfeit and pay to the said president, managers
and company, a sum not less than five dollars, nor
more than eight dollars, to be recovered in the same
manner as debts under fifty dollars are recovered.

Dividends.

18. AND BE IT ENACTED, That the said com-
pany shall keep a just and true account of all and
every the monies to be received by their several and
respective collectors of tolls, at the several gates and
turnpikes on said road, from beginning to end, and
of the rents of all such parts of said road as shall be
farmed or rented out, and shall make and declare a
dividend of the clear profits and income thereof
(all contingent cost and charges being first deducted, )
among all the stockholders of said company; and
shall on every second Monday in January and July,
in every year, publish the half yearly dividend to be
made of the said clear profits among the stock-hold-
ers, and of the lime and place when and where the
