it was by said act, and the provisions of this act; and
said commissioners shall also, in manner aforesaid,
determine how much each proprietor of the lots on
the east side of said alley shall pay to make up said
damages. And each proprietor of ground on the
east side adjacent to said alley, as determined as
aforesaid to be the true division, shall become the
proprietor of the ground westwardly, the breadth of
his or her lot as far as Argyle-alley, as laid out in

1812.

pursuance of said act: Provided, That such proprie-
tors respectively pay the sum which shall have been
adjudged as aforesaid; and said commissioners, or a
majority of them, are hereby empowered and, direct-
ed, to make to such proprietors respectively, deeds
for the ground of which they shall so become proprie-
tors. But if any of said proprietors shall refuse to
pay the sum determined on as aforesaid, then shall
the ground between the lots of those refusing and
said alley as laid out by said act, become the property
of those holding property on the west side of said
alley opposite to it, and said commissioners or a ma-
jority of them, are hereby empowered to make a deed
therefor accordingly; and such acquisition of ground
shall stand in lieu of. money to be paid or damages.

Proviso.

;;. 2 AND BE IT ENACTED, That the said
commissioners of a majority of them, before they
shall proceed to carry this act into effect, shall give
two weeks notice in two of the public news-papers
edited in the city of Baltimore, of the time and place

3. AND BE IT ENACTED, That the said com-
missioners or a majority of them, if they should find
it necessary, may adjourn from day to day, until they
shall have fulfilled and discharged the several duties
required to be performed by the provisions of this
act; and if any of -the said commissioners shall die,
resign or refuse to act before the said duties have
been performed, it shall be the duty of the mayor of
the city of Baltimore for the time being, to till up
such vacancy or vacancies by a new appointment.

4. AND BE IT ENACTED, That the said com-
missioners, before they shall proceed to execute the
duties of the trust hereby reposed in them, shall take
an path before some person competent to administer
the same, to execute, fulfill and discharge the said
duties without favor, affection or partiality.
