vided, That the said portico shall be elevated at least
ten feet above the foot pavement: And provided also,
That if the grand jury for Baltimore county, shall at
any time present on oath, that the said portico is dan-
ferous or inconvenient to the citizens, and it shall
be so found on trial by verdict of a petit jury, it shall
be the duty of the sheriff of Baltimore county for the
time being, to cause the said portico to be removed,
unless the same shall be removed by the proprietors
within ten days after finding such verdict

CHAPTER 137.

1812.

Proviso.

An act for the relief of James Fennell.
BE IT ENACTED by the General Assembly of
Maryland, That James Fennell, now in confinement
in Baltimore county jail, shall be, and he is hereby
entitled to receive the benefit of the act entitled,
"An act for the relief of sundry insolvent debtors, "
and the several supplements thereto, according to the
terms and conditions prescribed in said acts, without
being obliged to furnish evidence that he has resided
two years within the State of Maryland.

CHAPTER 138.

Benefits of the
insolvent laws
granted.

An act relating to the Governor and Council of this
State.

Passed Dec.
23, 1812.

WHEREAS, By an act entitled, "An act to alter
the time of the meeting of the General Assembly of
this State, and for other purposes, " passed at Novem-
ber session eighteen hundred and eleven, it is pro-
vided, that the Governor and Council shall be elected
in the month of December, instead of the month of
November as heretofore: And whereas, Doubts are
entertained whether a suspension of executive pow-
ers will not thereby occur: For remedy whereof,

Preamble.

BE IT ENACTED by the General Assembly of
Maryland, That the present Governor and Council
of this State be, and they are hereby authorised and
empowered to act in their executive capacity until the
times severally prescribed for the next election of a
Governor and Council by the above recited act.

CHAPTER 139

Executive.

A supplement to an act entitled, An act to grant a
public road and confirm the same, in the upper part
of Queen Ann's county.
