of the other trustees who do not attend, do any act,
matter or thing which the whole number of trustees
or a majority of them might do were they present or
attending, any thing in any law to the contrary not-
withstanding.

Preamble.

AND WHEREAS, The lot of ground on which
the said academy now stands, was purchased from
Dr. Joseph E. Muse, who conveyed the same to
the use of the said academy or school: Therefore,

Land shall re-
main to the
use of the

Academy.

8. BE IT ENACTED, That all land so purchased
from and conveyed by Dr. Joseph E. Muse for
the use aforesaid, shall be and forever remain to the
use of the said academy; and the trustees of the said
academy and their successors, shall be vested with
all the right, title, interest and estate in the said
land, subject to the use aforesaid.

CHAPTER 124.

A supplement to an act entitled, "An act to ap-
point commissioners to grade and level the several
squares, streets, lanes, and alleys in the precincts
of Baltimore, west of Jones' Falls. "

SEC. 1. BE IT ENACTED by the General As-
sembly of Maryland, That whenever two thirds of
the owners of property in the said precincts, shall
make application in writing, for the purpose of le-
velling to the grade established of any street, lane
or alley, the commissioners shall give ten days no-
tice, of such application in one or more of the news-
papers printed in Baltimore, and if after that time
the owners of property do not commence to cut
down or fill up and complete the same at and within
such time as may be allowed by the commissioners,
then and in that case, the commissioners are hereby
authorised and empowered, to contract on the most
reasonable terms, for the cutting down and filling up
such street, lane or alley, and charge, levy, assess
and collect the cost and expense of the work done on
the lots of ground opposite to such cutting down
and filling up, agreeably to the number of feet in
front of each lot, and according to the quantity of
earth cut down or filled up opposite each, as near as
the same can be ascertained.

2. AND BE IT ENACTED, That whenever

lane or alley shall make application in writing, for
paving or levelling and paving to the grade estab-
