from each and every such person on whom they have
assessed and charged in the manner aforesaid, the
amount and amounts of such assessment and assess-
ments before a justice of the peace, if within his ju-
risdiction, and if not, before the Baltimore county
court; which action or actions shall be brought in the
name of the eastern precincts commissioners, and in
which it shall be sufficient to declare for money had
and received; and this act and the proceedings under
the same may be given in evidence in support of such
action or actions.

Preamble.
|
WHEREAS, It is represented to this General
Assembly by the petition of sundry inhabitants of
Baltimore county, that the jail of said county is unen-
closed, an, d that great inconveniences arise from the
facility thereby afforded to an intercourse between
the prisoners and the people at large; for the preven-
tion of which the said petitioners pray that a law
may pass providing for the erection of a wail around
the said jail; Therefore,

SEC. 1. BE IT ENACTED by the General Assem-
bly of Maryland, That it shall be the duty of the levy
court of Baltimore county as soon as may be practi-
cable, to cause to be erected a substantial wall of
stone or brick, not less than twelve feet, in the dis-
cretion of said levy court, above the surface of the
ground, on the limits of the prison lot of said county,
so as to enclose all that part thereof, lying east of the
road leading from that part of the city of Baltimore
called Old-Town, towards Pennington's mill, on
Jones' Falls, and to finish the said wall with such and
so many gateways and gates as the said levy court
shall think necessary; and to erect and build at or
near the principal entrance or gateway of said prison
lot, a small convenient lodge or house, of brick or
stone, and finish the same for the accommodation of
a porter or guardian of said prison lot; and also to
cause to be divided into three or more wards, the
said prison lot, and thereon erect division or partition
walls of stone or brick, of such dimensions and with
such gateways and gates therein, as they shall think
necessary to preserve the health, safety and good go-
vernment of the prisoners.
