answerable for the failure to collect any fees so placed
in their bands, as aforesaid, unless the same by the use
of due diligence could have been collected.

SEC. 4. And be it enacted, That this act shall take
effect and be in full force from and after its passage.

CHAPTER 64.

AN ACT to provide for making an index of judgments
and decrees for the circuit court of Anne Arundel
county, and directing the county commissioners to
levy by a tax, a sufficient sum to pay for the some.

Preamble.

WHEREAS, The present mode of indexing judgments
and decrees, by the clerk of the circuit of Anne Arun-
del county, is in the name of the first named defend-
ant on the record, and judgments superseded arc not
in any manner indexed against the superseders in
said judgments, which is calculated to injure pur-
chasers and disturb titles, to remedy which,

Clerk.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That from and after the passage of this
act, whenever a judgment is rendered in said court, it
shall be the duly of the clerk of said court, to enter upon
his index, to be kept for that purpose, the names of all
the defendants against whom said judgments have been
rendered.

SEC. 2. And be it enacted, That whenever a judg-
ment rendered in said court shall be superseded, it shall
be the duty of the clerk of said court to index the names
of all persons superseding the same.

SEC. 3. And be it enacted, That the clerk of said
court be, and he is hereby authorised and directed, to
index all judgments standing open on the docket of
said court for twelve years last past, in the names of all
the persons against whom said judgments have been
rendered or superseded; and for doing the same, shall

receive such compensation as the county commissioners
for Anne Arundel county, shall deem proper and right;
and said commissioners are hereby authorised and di-
rected, to levy by a tax upon the assessable property of
