breach of any ordinances unless the master or mistress
pay the fine and costs annexed to the offence, and to
pass all ordinances necessary to give effect and opera-
lion to all the powers vested in the said corporation of
Emmittsburg.

Power to ap-
point clerk.

SEC. 7. And be it enacted, That the said commis-
sioners or a majority of them shall have power to ap-
point their own clerk, assign him his duties, and allow
him such compensation for his services as they may
think proper, and all ordinances passed by the said
commissioners, shall by their clerk be entered in a hook
to be kept by him for that purpose, which shall be open
at all times for the inspection of any person interest-
ed, and it shall he the duty of the Burgess to sign all
by-laws and ordinances, and copies of all ordinances
shall be put up in the most public places of the corpo-
ration, that the same may be more generally made
known.

SEC. 8. And be it enacted, That a constable may be
appointed for the said town in such manner and with
such compensation as may be directed by ordinance of
the said corporation, who shall have all the power and
authority of the county constables, within the limits of
the corporation, except in the cases of civil process, and
that in like manner a collector of any taxes imposed by
virtue of the powers granted by this act may he appoint-
ed, who shall have power to collect the same by dis-
tress or execution, upon either real or personal property
of any person refusing or neglecting to pay any taxes

Provisoes.

so imposed; Provided, however, that the said Collector
before he shall so proceed, shall first leave with the
parly by whom the said taxes are to be paid or at his or
her usual place of abode or on the property in case said
party does not reside in the said town of Emmitsburg,
a statement showing the aggregate amount of the pro-
perty of every description with which such person is
assessed and the amount of taxes due thereon with a
notice annexed to said statement, that unless the taxes
so due are paid within thirty days thereafter he the said
collector will proceed by way of distress or execution as
the case may be to collect the same, and if after having
given thirty days notice as aforesaid the said taxes are
not then paid, the said collector shall proceed to levy
upon either the real or personal property as aforesaid
of the delinquent and expose the same to public sale
either on the premises or at some public place in said
town, having first given at least ten days notice in writ-
ing or print of. the time and place of such sale in a num-
