Winchester, in Carroll county, through Taneytown, in
raid county, and through Emmittsburg, in Frederick
county, to the Pennsylvania line, passed at December
session, eighteen hundred and forty-six, chapter two
hundred and forty-two, passed at the session of eigh-
teen hundred and forty-nine, chapter two hundred and
thirty-seven, which relates to them, and for that pur-
pose to agree or construct or make any arrangement
with the president, managers and company of the
Westminster and Hagerstown Turnpike Road Com-
pany in such manner as to enable the said John Smith,
David Fontz, John Roberts and their successors, to aid
in the construction of a turnpike road from the west
end of Uniontown to the present completed terminus
of the road made by the said Westminster and Hagers-
town Turnpike Road Company, and to do all such
things as may be necessary to the constructing, receiv-
ing of tolls and keeping in repair said section of road.

Vacancy, how
to be filled.

SEC. 2. And be it enacted, That in the event
of the death of one or more of the said commissioners,
their places shall be supplied by the survivors.

Authority to
receive mo-
ney.

SEC. 3. And be it enacted, That the said commis-
sioners shall be entitled to demand and receive from
the lottery commission the sum of money authorised by
the act of eighteen hundred and forty-nine, chapter two
hundred and thirty-seven, or so much thereof as has
not been heretofore paid over to them, and when re-
ceived shall be invested by them, until such time as
the fund will be sufficient to construct said section of
road.
