SEC. 11. And be it enacted, That this act shall take
effect from and after its passage.

CHAPTER 223.

AN ACT authorising the commissioners of Frederick
county, in their discretion, to levy a sum of money to
build a bridge over Catoctin Creek.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the county commissioners of Fre-
derick county, be, and they are hereby authorised and
empowered, in their discretion, to levy on the assess-
able properly of said county a sum not exceeding twen-
ty-five hundred dollars, in three equal annual instal-
ments, for the purpose of building a bridge over Catoc-
tin creek, in said county, at or near Gartzendafner's
mill, where two county toads meet, one running from
Funk's old mill, and the other from Berlin.

SEC. 2. And be it enacted, That the county com-
missioners of said county are hereby authorised and em-
powered to appoint three commissioners to view and

examine the ground and fix upon the proper site of
situation for building said bridge, and make condemna-
tion of lands for the same, and also for the necessary
road, in order to pass to and from said bridge, should a
departure from the bed of the old road become neces-
sary, by reason of fixing on some other situation than
where the present public road crosses said creek.

SEC. 3. And be it enacted, That the said county
commissioners be, and they are hereby authorised to
contract with any person or persons to build said bridge,
and are required to take bond or bonds, with sufficient
security, from any contractor or contractors, for the
faithful performance of the contract.
