furnished a substitute, the said justice may fine every
delinquent free person, or if a slave the master, owner
or employer of said slave the sum of seventy-five cents
for each and every day the said free person or slave
shall have been a delinquent or failed to work as afore-
said, and the said justice shall order the said person so
fined to stand committed until the fine and fees are
paid.

SEC. 7. And be it enacted, That the several super-
visors shall receive and annually account to the com-
missioners of said county, for the fines recovered from
all delinquents as aforesaid, to be expended under the
directions of said commissioners in the repair of the
several roads under the jurisdiction of said supervisors.

SEC. 8. And be it enacted, That in all cases where
fines may be imposed under the provisions of this act,
the party feeling themselves aggrieved may appeal to
the circuit court as now provided by law in other cases
from the decision of justices of the peace; Provided,
the party so appealing shall within five days enter into
bond and with good and sufficient security, in the pen-
ally of twenty dollars to prosecute his appeal with ef-
fect

SEC. 9. And be it enacted, That in all prosecu-
tions under this act the supervisor, his agent or depu-
ties shall be competent witnesses for the State.

SEC. 10. And be it enacted, That this act shall take
effect from and after its passage.
