such offence, the sum of fifty dollars to be recovered
and applied in manner and form as provided by the
second section of this act; Provided nevertheless,

SEC. 5. And be it enacted, That the provisions
of the section last aforesaid, shall not extend to the
case of a sale or delivery of spirituous or fermented
liquors, to any servant or slave who may have a written
order or license for the purpose from his master, mistress,
overseer or other person in whose employment, he may

be with the consent of his owner; and provided, also,
that if it shall appear in any case that the spirituous or
fermented liquor sold or delivered to any negro or mu-
latto servant or slave, against the provisions of this act,
was so sold or delivered for cause of sickness or other rea-
sonable and sufficient cause to be judged of by the
court or jury by whom the case shall be tried, then the
party accused shall be entitled to a verdict and judg-
ment of acquittal against such charge.

Proviso.

SEC. 6. And be it enacted, That if any retailer, or-
dinary keeper or licensed trader shall be convicted of
any offence against the provisions of this act, the court
before whom the conviction is had shall and may in its
discretion adjudge the license of the person convicted
to be forfeited, and in such case no other license shall
be granted to the person so convicted, or to any person
for his use at any time within the space of five years
thereafter, without the special allowance of the said
court.

SEC. 7. And be it enacted, That a copy of this act
shall be furnished by the clerk, to each person receiving
a license under the provisions of this bill, for which he
shall receive fifty cents, and the clerk shall, before he
delivers any license granted by this act, administer and
endorse upon the said license the following oath or af-
firmation. I. A. B. do sweat upon the Holy Evange-
ly of Almighty God, that I will faithfully comply
with the provisions of the act passed at the session of
eighteen hundred and fifty-four, &c.

SEC. 8. And be it enacted, That this act shall ex-
tend to Saint Mary's, Charles, Prince George's, Cal-
vert, Anne Arundel, Howard and Somerset counties,
and shall go into effect on and after the first day of May
next.
