SEC. 3. And be it enacted, That said councilman or
a majority of them, shall have full power to put the
bond of said mayor in suit, for the recovery of all monies
belonging to said corporation, which the said mayor

SEC. 4. And be it enacted, That the mayor and
councilmen of said corporation, shall appoint the judges
to hold all elections under the charter of said corpora-
tion.

CHAPTER 183.

Judges of
election.

AN ACT in addition to the act, to authorise the removal
of causes depending in the court of chancery, passed
at the session of eighteen hundred and fifty-three,
chapter one hundred and twenty-three.

Mar. 10, 1854.

SECTION 1. Be it enacted by the General Assem-
bly of Maryland, That if on the hearing of any appeal
from a decree or order of the court of chancery, it shall
become necessary to remand the cause for further pro-
ceedings, the court of appeals instead of remanding said
cause to the court of chancery, shall direct the said cause
to be sent the court of the city or county, having equity
jurisdiction, wherein the cause might have been insti-
tuted at the time the same was originally commenced
in the court of chancery, and if the said cause might
have been commenced in some one of two or more
courts having equity jurisdiction, at the election of the
complainant, then the court of appeals shall have the
discretion to send the cause to such one of said courts
as may in the judgment of the court of appeals, be most
convenient to the parties materially interested in the
further proceedings directed to be had in the cause, and
to prompt and efficient administration of justice therein.
