another inquisition to be taken in the manner above
described and such inquisition shall describe the proper-
ty taken or the bounds of the land condemed, and the
quantity or duration of the interest in the same, valued
for the company, and such valuation when paid or
tendered to the owner or owners of said property or his,
her, or their legal representatives, shall entitle the said
company to the estate and interest in the same thus
valued as fully as if it had been conveyed by the own-
er or owners of the same, and the valuation if not re-
ceived when tendered, may at any time thereafter be
received from the said company without costs by the
said owner or owners, or his, her or their legal repre-
sentative or representatives.

SEC. 6. And be it enacted, That nothing contained
in this act shall authorise the said company to use or
divert the waters of the north branch of Potomac river
in Allegany county, from their usual course for any
purpose whatever, unless said company shall have first
obtained the consent of all persons who may own or have
an interest in any water right on said river to be affect-
ed by such use, and unless said company shall have
first agreed or contracted with the owner or owners of
any water right that may be affected as aforesaid, or
with his, her or their legal representatives, as to the com-
pensation to be paid for the use of such water rights for
the purposes of said company.

SEC. 7. And be it enacted, That this act shall take
effect from its passage, and the legislature hereby re-
serves to itself the right to alter or repeal this act at plea-
sure.
