Proviso.

once in two years; Provided, that no exception shall
be taken or be sustained to this incompetency of a
juryman, after he has been, sworn, and empannelled in
a cause.

CHAPTER 102.

Mar. 8, 1854.

AN ACT to amend the act passed at January session
eighteen hundred and fifty-three, chapter two hun-
dred and forty-nine, entitled, an act to incorporate a
company to construct a Turnpike Road from Hagers-
town, in Washington county, to Smithsburg, so as to
prescribe by whom notice shall bo given, the mode of
voting and enforcing payment of subscription to the
stock, and also to regulate the tolls.

Amended.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That so much of section second of the
act passed at January session, eighteen hundred and
fifty-three, chapter two hundred and forty-nine, as re-
quires a majority of subscribers to the stock of said cor-
poration to give three weeks notice by publication in
one or more newspapers, published in Hagerstown, or
the time and place for the stockholders in said corpora-
tion to meet, for the purpose of organization, be, and
the same is hereby so altered and amended as to autho-
rise a majority of the persons named in the first section
of said act, to give the notice required by said second
section.

Voting.

SEC. 2. And be it enacted, That the stockholders
shall be entitled to vote, either in person or by proxy,
according to the number of shares held.

Investments.

SEC. 3. And be it enacted, That the president and
any three of the managers of said corporation may re-
quire the subscribers to the stock of said corporation to
pay the same in such instalments and at such times as

said demand shall have been given by said president
