CHAP. 113.

Titles good.

Proviso.

SEC. 2. And be it enacted, That all title or titles, de-
rived under or by virtue of said deed, be, and the same
is hereby made good, notwithstanding the defects in
said acknowledgment; Provided, however, that this
act shall have no effect to defeat the rights of any par-
ties, as creditors or otherwise, which may have hereto-
fore attached.

CHAPTER 113.

AN ACT for carrying into execution the powers vest-
ed by the Constitution in the Commissioner of Lot-
teries.

Present com-
missioner to
complete acts

of late com-
missioner.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That the present lottery commissioner,
and his successors in office, shall have all the powers
and perform all the duties of the late lottery commis-
sioners, shall draw the Maryland consolidated lotteries,
as recognized by them, and do and complete all acts
that they might have done if continued in office; Pro-

vided, that no lottery commissioner shall enter upon
the duties of his office until he shall have first given
bond for the faithful performance thereof as required by
the constitution.

Vacancy to be
filled by Gov-
ernor.

SEC. 2. And be it enacted, That in case of a vacan-
cy in the office of lottery commissioner, by the remov-
al, death, resignation or disqualification of said officer
the vacancy shall be filled by appointment by the Gov-
ernor, and the person so appointed shall hold said office
until the election and qualification of his successor.

Contracts—
how to be
made.

SEC. 3. And be it enacted. That for the purpose of
making a contract or contracts as required by the fifth
section of the seventh article of the Constitution, the
commissioner of lotteries may accept a surrender of any
existing contract, and every contract hereafter made
shall provide for the payment to the Treasurer, by the
contractor or contractors, in equal quarterly instalments,

of the sum secured to the State, and for the payment
on the draft of the lottery commissioner to the persons,
or bodies politic, or corporate, entitled thereto, in equal
semi-annual instalments, of the sum to be distributed
amongst the existing lottery grants during the term of
such contract.
