CHAP. 58.

over to the commissioners of said county for county

Negroes and
and mulattoes
— penalty.

SEC. 4. And be it enacted, That if any negroes or
mulattoes are found guilty of violating this act, and they
are not able to pay their fine, then the justice may
order not over thirty-nine lashes to be indicted on such
negro or mulattoe.

Citizens of
Worcester
may plant oys-
ters, &c.

SEC. 5. And be it enacted, That this act shall not
be construed, so as to prohibit citizens of Worcester
county from planting oysters in the waters of said
county, and the same to be protected by a law hereto-
fore passed by the Legislature of this State.

In force.

SEC. 6. And be it enacted, That this act shall be in
force from and after the first day of April next.

AN ACT entitled, an act to make valid a Deed from
Ann Jenkins, Denton Milter, and Margaret Ann, his
wife, and James P. Jenkins, of Howard District, of
Anne Arundel County, in the State of Maryland, to
Eliza Ellen O'Neal, of the same District and State.

Preamble.

WHEREAS, It is represented to this General Assem-
bly, that a deed was executed by Ann Jenkins, Denton-
Miller, and Margaret Ann, his wife, and James P. Jenk-
ins, to Eliza Ellen O'Neal, bearing date on the seventh
day of November, eighteen hundred and forty-nine ;
and whereas, in the execution of said deed, the ac-
knowledgment sets forth that the said Margaret Ann
Miller was "privately examined, apart from and out of
the hearing of her husband," instead of selling forth,
as required by law, that the said Margaret Ann Miller,
"was privately examined, out of the presence and
hearing of her husband." Therefore,

Deed made
valid.

SECTION 1. Be it enacted by the General Assembly

of Maryland, That the deed from Ann Jenkins,
Denton Miller, and Margaret Ann, his wife, and James
P. Jenkins, to Eliza Ellen O'Neal, dated the seventh
day of November, eighteen hundred and forty-nine,
and duly recorded in Liber E. P. H. No. 9, folio 365,
one of the Land Record books of Howard District, of
Anne Arundel county, shall be, and the same is hereby
