tract for the fixtures and improvements thereon as afore-
said, and upon the faithful execution of the said con-
tract by the party or parties thereto, it shall be the duty

of the said commissioners, or a majority of them, to
make a full report of all their proceedings to the Gov-
ernor, and after they shall have expended the amount
received for the sale of the aforesaid land and other
improvements, directed to be sold by the first section of
this act, they are hereby authorised, with the consent
and approval in writing of the Governor, to draw upon
the Treasurer of the State for such sum or sums of
money as may remain due on account of the said pur-
chase and improvements, and pay over the same to the
person or persons entitled thereto; and the said Trea-
surer is hereby directed, upon the warrant of the Comp-
troller, to pay such sum or sums of money to the
aforesaid commissioners or their order, out of any un-
appropriated money in the treasury.

CHAP. 356.

SEC. 4. And be it enacted, That the commissioners
aforesaid, shall before they enter upon the execution of
the trust aforesaid, execute a bond to the State of Mary-
land, with security, to be approved of by the Governor,
conditioned for the faithful performance of the duties
imposed upon them by this act; and when the said du-
ties shall have been discharged by them, they shall re-
ceive compensation for their services, at the rate of three
dollars per day, for each and every day necessarily
spent by them in the actual performance of the duties
hereinbefore specified, and the number of days spent
by each commissioner as aforesaid, shall be rendered
by him, upon his oath or affirmation, to the Governor,
who shall certify the same to the Comptroller, where-
upon the Comptroller shall issue his warrant to each
commissioner for the amount certified as due for his
services aforesaid, and the treasurer shall pay the same
out of any unappropriated money in the treasury.

SEC. 5. And be it enacted, That the sale of the

present cattle scales, directed to be made by this act,
and the purchase of the additional ground to be pur-
chased in virtue of its provisions, shall not be valid
until approved by the Comptroller of the State.

SEC. 6. And be it enacted, That if any of the said
commissioners herein named, shall fail or refuse to give
bond as prescribed in this act, for the faithful perform-
ance of their duties, when required thereto by the
Governor, it shall be the duly of the Governor to ap-
point some suitable person or persons in the place of
the person or persons thus failing or refusing, who shall
give bond as aforesaid, and perform the duties assigned
by this act.
