CHAP. 326.

of the condemnation of any lands or materials for the
use of said railroad, shall be paid by said rail road com-
pany.

Established
road or way.

SEC. 15. And be it enacted, That whenever, in the
construction of said road or roads, it shall be neces-
sary to cross or intersect any established road or way,
either public or private, it shall be the duty of said pre-
sident and directors of the said company, so to con-
struct the said road across such established road or way,
as not to impede the passage or transportation of per-
sons or properly along the same; or when it shall be
necessary to pass through the lands of any individual,
it shall, also, be their duty to provide for such indi-
viduals, proper wagon-ways across said road or roads,
from one part of his land to the other; and whenever
any road or roads may hereafter be authorised to be
made by the Legislature, where it may be necessary to
cross said rail road, the company shall make or cause to
be made, a proper and convenient way for said road to
Cross, the expense of which shall be paid as the Le-
gislature may direct.

Wagon ways.

SEC. 16. And be it enacted, That if the said com-
pany should neglect to provide wagon ways across
said road, as required by the fifteenth section of this
act, it shall be lawful fur any individual to sue said
company, and be entitled to such damage as a jury may
think him or her entitled to, for such neglect or refusal
on the part of said company.

Public high
way.

SEC. 17. And be it enacted, That the Baltimore
and Philadelphia rail road, with the lateral ways, shall
be deemed and is hereby declared a public highway,
subject to the imposition of tolls, to be hereafter regular
ed by this act.

Start and run
cars at regular
times.

SEC. 18. And be it enacted. That said company
shall start and run their cars for the transportation of pas-
sengers and property, at regular times, to be fixed by
public1 notice; and shall furnish sufficient accommoda-
tions for the transportation of all such passengers and
property, as shall, within a reasonable time previous
thereto, be offered for transportation at the place of start-
ing, and at usual stopping places established for re-
ceiving and discharging way passengers and freight for
that train, and shall take, transport and discharge such
passengers and property, at, from and to such places,
on the due payment of the freight or fare, legally au-
thorised therefor; and shall be liable to the party ag-
grieved, in an action for damages, for any neglect or
refusal in the premises.
