CHAPTER 297.

AN ACT relating to Non-Resident Guardians of

Infants, living out of this Slate, and having Pro-
perty therein in the lands of Trustees appointed
by Will.

SECTION 1. Be it enacted by the General Assem-

of Maryland, That where any infant or infants is, or
are, or shall hereafter be entitled to the proceeds, or to
any part thereof, of any sales of properly in this State,
or to any legacy, bequest, or distributive share of any

personal property in the hands of any trustee appointed
by will, and such infant, if male, is or shall be under
the age of twenty-one years, or if female, under the
age of eighteen years, and not residing in this State,
but residing in some other State, District of Columbia,
or territory, of the United States, and having a
guardian in such other State, District of Columbia,
or territory, duly qualified according to the laws thereof,
and who shall there have given good and sufficient se-
curity for the faithful performance of his or their trust,
as such, or words to that effect, then and in such case,
the orphans' Court of the county or city, in which the
trustee so appointed resides, may order and direct such
trustee to pay, transfer, or deliver such proceeds of
sale, or such part thereof, as the infant may be enti-
tled to, or such legacy, bequest, or distributive share, to

such guardian or guardians; Provided, however, that
before any such order shall be passed, such guardian or
guardians shall first file a petition, setting forth the
like facts, as are now, by law, required, in cases where
the proceeds of sale, or any part thereof, of property in
this State, or any legacy, bequest, or distributive share

of any personal property, is or are in the hands of any
executor, administrator, or guardian in this State; and
the Orphans' Court shall be satisfied of the truth of
said facts.

Proviso.

SEC. 2. And be it enacted, That the said Orphans'

Court, before passing such order, may require the said
guardian to execute a bond to the State of Maryland,
as required by the law; of this State, in the case of
proceeds of sale, or any part thereof, legacy, bequest, or
distributive share, being in the hands of any executor,

when executed, shall he recorded in the office of the
Register of Wills; and any person interested therein,
shall be entitled to a copy of said bond, and a certifi-
cate of the register, under the hand and seal of his
