CHAP. 291.

thorised and inquired, to levy upon the assessable pro-
perty of said county, annually, such sum as may be
due and owing to said judges respectively, for each day
they may attend as such.

SEC. 3. And be it further enacted, That this act
shall take effect from the date of its passage.

AN ACT declaring it a Misdemeanor to remove
Sand or Gravel from the Shore of the Potomac
River.

Not lawful to
carry away
sand, gravel
or other mat-
ter.

SECTION 1. Be it enacted by the General Assembly

of Maryland, That from and after the passage of this
act, it shall not be lawful for any person or persons,
other than the owner or owners, or by his, her or their
permission, to take or carry away from any shore of the
Potomac river, below Fort Washington, which has
been, is or may be used as a fishery, any sand, gravel
or other matter that may form a part of said shore, to
the amount of ten bushels or more, with the intention

of converting the same to his, her or their own use;
and any person or persons so doing shall bo adjudged
guilty of a misdemeanor, and on conviction thereof,
before the Circuit court of the county in which such
misdemeanor shall have, been committed, shall be fined
not less than five dollars, nor more than one hundred,
or be confined in the county jail for a period of not less
than thirty days nor more than ninety days.

Fine imposed.

SEC. 2. And be it enacted, That the fines imposed
by this act shall be paid, the one-half to the informer,
and the other half to the owner of the shore from which
such sand or other matter may be taken.
