A FURTHER SUPPLEMENT to an Act en-
titled, an Act for the preservation and repair of that
part of the United Sates Road lying within the
limits of Maryland, passed at December Session,
one thousand eight hundred and thirty-one, chapter
eighty-five.

SECTION 1. Be it enacted by the General As-
sembly of Maryland, That it shall be the duty of the
superintendent of that part of the United States road
lying within the limits of this State, from and after the
passage of this act, to set apart twenty-five per cent of the
gross receipts of all the tolls hereafter received on said
road, and to pay the some to the administrator of John
Swan, deceased, late superintendent of said road, until the
amount thus set apart and paid over shall be sufficient to
discharge the sum of four thousand seven hundred and
twenty-nine dollars and twenty-six cents, and the interest
accruing thereon, it being the sum found due to the estate
of the said John Swan, deceased, from the said road,
by Jacob Fechtig, William Frost and Joseph Logdson,
of S., auditors appointed in the premises by the com-

missioners of Allegany county; Provided, however,
that if any other claim or claims have been paid by
said John Swan, or that may be due by the said road for
which the estate of the said John Swan may be liable,
and not included in the account of said creditors, shall
hereafter be presented and established to the satisfaction
of the Orphans' Court of Allegany county, the sum
so directed to be set apart and paid over shall be en-
larged to meet the said claim or claims; And provided,
however, that any claims against said road. adjudicated
by the auditors appointed by the act passed at Decem-
ber session, eighteen hundred and forty-seven, chapter
two hundred and one, and which claims may remain
unpaid, shall be first satisfied out of the twenty-five per
cent of tolls, authorised to be set apart by this act.

SEC. 2. And be it enacted, That the books, audits,
accounts and vouchers of John Swan, late superinten-
dent of the national road, shall be deposited in the of-
fice of the register of wills, of Allegany county, and
that they shall be liable to the same examination as any
other paper in said office.
