CHAPTER 57.

Passed Dec. 27,
1811.

An act to repeal the third section of an act entitled,
An act continuing an act relating to costs in
criminal cases.

Preamble.

WHEREAS, Doubts exists whether the third sec-
tion of the act passed at November session, in the year
seventeen hundred and eighty-seven, be now in force
and operation or not: Therefore,

a certain provi-
sion.

BE IT ENACTED by the General Assembly of
Maryland, That the third section of an act passed at
November session seventeen hundred and eighty-se-
ven, entitled, An act continuing the act relating to
costs in criminal cases be, and the same is hereby re-
pealed and declared to be null and void; Provided,
That there shall be deducted from such costs in every

county, the same percentage as may or shall be paid
by the levy court of any county for collecting the levy
of said county.

CHAPTER 58.

Passed Dec 27,
1811.

A Supplement to the act entitled, "An act au-
thorising commissioners to make sale of the land
of which William Warman Berry died possessed.

Preamble.

WHEREAS, It is represented to this General As-
sembly, that George Magruder, John Evans and Tho-
mas Bowie, the commissioners appointed by the act
to which this is a supplement, to make sale of the
land and premises of which William Warman Berry
died possessed, have refused to perform the services
required of them by the said act; and it is prayed that
the orphans' court of Prince George's county be au-
thorised to appoint a commissioner or commissioners
lo carry the said act into effect, and the game appear-
ing reasonable: Therefore,

BE IT ENACTED by the General Assembly of
Maryland, That the orphans' court of Prince George's
county be, and are hereby authorised and empowered
to appoint a commissioner or commissioners, as to the
said court may appear advisable, who shall enter
into bond to the state of Maryland, in such penalty
and with such security as the said court may approve,
which bond shall contain the condition, be recorded,
and the obligors therein may be sued as is directed
and authorised by the act to which this is a supple-
ment; and the commissioner or commissioners who
