LAWS OF MARYLAND.

1812.

ate on the west side of Howard street, in the city of
Baltimore, to the said James Lowrey Donaldson and
Sarah Ellis, in trust for the use of the said Sarah Ellis
and her children, by him the said John Ellis. And,
whereas, it is also represented by the said Barnes Low-
rey Donaldson and Sarah Ellis, that the rests and pro-
fits of said house and lot are not sufficient to support
and maintain said Sarah and her children; and have
prayed that a law may pass authorising the sale of the
said house and lot, and that the money arising from,
such sale be applied to the support and maintenance of
the said Sarah Ellis and her children; and the prayer
of the petitioners appearing reasonable: — Therefore,

ised to dispose
of said proper-
ty.

BE IT ENACTED by the General Assembly of
Maryland, That the said James Lowrey Donaldson be,
and he is hereby authorised as trustee of the said Sarah
Ellis and her children, to sell on a credit of six, twelve
and eighteen months with interest from the day of
sale, at public auction, to the highest bidder, the house
and lot aforesaid, on his giving three weeks notice in
some of the public newspapers published in the city of
Baltimore, of the time and place of such sale; and oil
the receipt of the whole of the purchase money, to
make and execute to the purchaser or purchasers, a
good and sufficient deed of bargain and sale, thereby
conveying all the right, title and interest of the said
John Ellis, to the said house and lot.

filed in the of-
fice of the re-
gister of wills.

& AND BE IT ENACTED, That before the said
James Lowrey Donaldson shall proceed to execute
the trust reposed in him by this act, he shall give bond
to the state of Maryland, with surety to be approved
of by the Orphans' court of Baltimore county, in the
penal sum of five thousand dollars, conditioned for the
faithful performance of the duties reposed in him by
this act; and that he will well and truly apply the sum
or sums by him received from the sale of said house
and lot, to the maintenance and support of the said
Sarah Ellis and her children by the said John Ellis, ac-
cording to the directions of the said court; which
said bond shall be filed in the office of the register of
wills for Baltimore county, there to be recorded; and
upon an office copy of which, a suit or suits may be
instituted in the name of the state of Maryland, for
the use of any person or persons interested therein.

Trustee shall
account with
the orphans'
court, &c.

3. AND BE IT EN ACTED, That it shall be the
duty of the said James Lowrey Donaldson to account
with the Orphans' court of said county, in the same
manner as guardians usually account, with respect to
the disposition and management of the funds arising
