court-martial, who shall refuse or neglect to attend at
the time and place appointed, he shall be fined in a sum
not exceeding one hundred dollars, nor less than twen-
ty-five dollars, unless he can give a reasonable excuse
to the court for such non-attendance; and any officer
summoned to attend as a member of a brigade court-
martial, who shall refuse or neglect to attend at the
time and place appointed, he shall be fined in a sum
not exceeding fifty dollars, nor less than ten dollars,
unless he can give a reasonable excuse; and any offic-
er summoned to attend as a member of a regimental
or extra-battalion court-martial, who shall refuse or
neglect to attend at the time and place appointed, shall
be fined in a sum not exceeding thirty dollars nor less
than five dollars, unless he can give a reasonable ex-
cuse; and any officer summoned to attend as a mem-
ber of a company court-martial, who shall refuse or
neglect to attend at the time and place appointed, he
shall be fined in a sum not exceeding ten dollars, nor
less than two dollars, unless he can give a reasonable
excuse; and any non-commissioned officer or private
summoned to attend as a member of a company court-
martial, who shall refuse or neglect to attend at the
time and place appointed, he shall be fined in a sum not
exceeding five dollars, nor less than one dollar, unless
he can give a reasonable excuse; and said fines shall
be collected under such regulations and on such con-
ditions as other fines of a similar description, by this
act directed; and when collected, paid over to the pay-
master of the respective regiments or extra battalions
to which such delinquent belongs, except in case where
a general-officer shall have incurred a fine; then, said
fine to be collected by the sheriff of the county in
which he resides, and the amount, (after deducting ten
per centum for collection, ) paid to the treasurer of the
Shore on which such delinquent resides.

Insurrections
and invasions.
|
6. AND BE IT ENACTED, That in case of an
insurrection or threatened insurrection within, or in
vasion or threatened invasion, of any part of this state,
a major-general, brigadier-general, commanding offic-
er of a regiment, battalion or extra-battalion shall
have power to order out the troops or any part of them
belonging to their respective districts where the insur-
rection or threatened insurrection, or invasion or
threatened invasion may be, or is expected to take
place; and the said commanding officer may call on
the commanding officers of regiments or extra-battal-
ions in the adjacent counties for such aid as he may think
