LAWS OF MARYLAND.

1812.
Justices of the
levy court shall
supply vacan-
cies Compen-
sation of the
commissioners.

AND BE IT ENACTED, That in case of the
death of one or more of the commissioners by said
justices appointed under this act; they, the said justi-
ces of the levy court, shall appoint another person or
persons in his or their stead; and the said commission-
ers shall receive two dollars for every day they act on
the business of said road.

An act fa make public an old Road in Harford
county.

Surveyor of Har-
ford county au-
thorised to lay
out, survey,
mark and bound
a certain road.
Its width, direc-
tion, &c.

BE IT ENACTED by the General Assembly of
Maryland, That the surveyor of Harford county be,
and he is hereby authorised and directed to lay out,
survey, mark and bound the old road in said county
thirty feet in width; beginning at or near the north
end of Benjamin M'Creery's field where the old road
intersects the road leading from Underhill's mill, to
Patrick Smith's lane, pursuing the old road by Tho-
mas Street's, until it intersects the road leading from
William Slade's mill to Belle-Air, near James St.
Clair's bars, and return a plot of said road when sur-
veyed and laid out, together with a certificate of the
courses of the same, to the clerk of said county, to be
by him recorded.

be levied on the

point an over-
seer— -he shall
give bond.

AND BE IT ENACTED, That when a plot of
said road shall be returned and recorded as aforesaid,
it shall and may be lawful for the levy court of said
county, to levy upon the assessable property of said
county, such sum of money as they shall deem neces-
sary under all circumstances; and appoint an overseer
to open and clear said road, agreeable to the plot and
certificate aforesaid, who shall give bond in like man-
ner as other overseers of public roads are directed to
give bond, and shall have the same allowance; and
the said road, when opened and cleared as aforesaid,
shall be deemed, and is hereby declared, to be there-
after a public road, and shall be kept in repair as
other public roads in said county.

AND BE IT ENACTED, That the surveyor
shall be entitled to receive two dollars for every day
he shall attend to discharge the duties required by this
act; to be levied, collected and paid as other county
charges are levied, collected and paid; Provided, the
said road shall not be laid through the land of any
person or persons, without the consent of the owner
or owners thereof.
