Maryland, That the levy court of Washington coun-
ty, be, and they are hereby authorised and directed to
appoint three commissioners, and they or a majority
of them, are hereby authorised to survey and lay off
a road, (provided they, after having viewed and sur-
veyed the grounds, and considered its utility, shall
deem it expedient) not exceeding thirty feet wide,
from Henry Snider's mill, in the most direct and prac-
ticable route, to intersect the turnpike road at a conve-
nient point, between the foot of the mountain and the
town of Boonsborough, so as the same shall not be laid
but over any orchard, garden, yard or meadow of any
person, without the consent of the owners, and when
surveyed and laid out, to return a plat thereof to the
clerk's office of said county, to be there filed and re-
corded.

AND BE IT ENACTED, That the levy court of
said county, when a plat of the road as aforesaid shall
be returned by the commissioners aforesaid, is hereby
empowered, at the next court thereafter, to appoint an
overseer or overseers to clear and open said road, and
to levy such sum of money as shall be considered rea-
sonable for the purpose of clearing and opening said
road; and the said road when opened and cleared,
shall be deemed a public road, and shall be kept in re-
pair in the same manner as other public roads in said
county are.

AND BE IT ENACTED, That the commission-
ers shall be entitled to receive as a compensation, the
sum of two dollars for every day they shall attend for
the discharge of the duties required of them by this
act; and the said overseer or overseers shall receive
the same compensation, which the overseers of public
roads respectively receive, which compensation shall
be levied, collected and paid, in the same manner that
other county charges are levied, collected and paid.

missioners, when they lay out said road, shall assess
the damages sustained by the individuals over whose
lands the said road may be laid out, and to return such
assessment to the levy court, to be levied, collected
and paid, as other county charges are levied, collected
