such sale; and that the said trustees, or a majority of
them may be authorised to convey any ground sold,
or which the said congregation may find it necessary
to sell for the purposes aforesaid; and the prayer of
the said petition appearing to be reasonable:

1811.

BE IT ENACTED by the General Assembly of
Maryland, That the said John Breidenback, Peter
Frick, Erasmus Uhler, Christopher Raborg and Hen-
ry Schroeder, or any three of them shall be, and they
are hereby authorised and empowered to convey to
the purchaser or purchasers of any part or parts of
the said lot or lots of ground held by them or either of
them, in trust for the German Lutheran congrega-
tion, or Lutheran congregation of Baltimore, men-
tioned as aforesaid, such part or parts of the said
ground as may have been sold by the direction of the
elders, trustees and church wardens of the said con-
gregation, or which they may direct to be sold; and
the deed of the said trustees, or any three of them, ex-
ecuted, acknowledged and recorded as other convey-
ances are required by law, shall be evidence of such
direction, and shall convey as good a title in law as if
the trustees had held the property so intended to be
conveyed in their own right and to their own use.

CHAPTER 137.

 

An act for the benefit of the heirs of Mark Guish-
ard, late of Baltimore county, deceased.

Passed Dec. 27,
1811.

BE IT ENACTED by the General Assembly of
Maryland, That David Guishard, of Baltimore coun-
ty, be, and he is hereby authorised and empowered as
trustee, to set up and expose to public sale, after giv-
ing six weeks notice in two of the newspapers publish-
ed in the city of Baltimore, of the time, place and
terms of sale, a part of a tract of land called Averilla's
Garden, and the said land to sell, together or in parcels,
on the following terms, to wit: the purchaser or pur-
chasers to pay one-third part of the purchase money
at the time of sale, and to give bond, with approved
security, bearing interest from the day of sale, for
the remaining two-thirds, payable in two separate
payments of six and twelve months.

AND BE IT ENACTED, That the said trustee,
on the receipt of the purchase money, shall, by a good
and sufficient deed, duly executed and acknowledged
according to law, grant, bargain, sell, make over and
