CHAP. 95.

whatsoever, so selling, shall, in each and every case,
forfeit and pay to the purchaser of such package or
parcel, packages or parcels, double the value of the
quantity of goods, which, on actual measurement, it
shall be found there is wanting in such package or
packages, parcel or parcels, to make up the number of
yards or quantity marked thereon.

How penalties
are recoverable.
|
SEC. 2. And be it enacted, That all sums not ex-
ceeding one hundred dollars, forfeited and payable
under the provisions of this act, shall be recovered by
the purchaser before a justice of the peace, as small
debts are recoverable, and all sums exceeding one
hundred dollars, forfeited and payable as aforesaid,
shall be recovered by the purchaser, by action of debt,
in the county court of the county in which such sales
were made.

An act to confirm and make valid the acts of James T.
Thomas, Justice of the Peace in and for Charles
County, and as one of the Justices of the District
Court of the Fourth Election District of said coun-
ty.

Preamble.
|
WHEREAS, doubts are entertained as to the validity
of the official acts of James T. Thomas, a justice of the
peace of this State, in and for Charles county, and who
is also a judge of die fourth election district court, in and
for Charles county, and it is right and proper that such
official acts shall be cured and made valid by law —
Therefore,

Made valid.
|
Be it enacted by the General Assembly of Mary-
land, That all the official acts of James T. Thomas, of
Charles county, in this State, as a justice of the peace
of said State, in and for said county, and as a justice of
the district court for the fourth election district in said
county, from the first day of March, eighteen hundred
and forty-eight, to the first day of January, eigh-
teen hundred and fifty, be and the same are hereby ren-
dered as valid and binding upon all parties thereto, and
to have the same force, effect and operation, as if the
said James T. Thomas had, before the performance of
said official acts, legally qualified in the capacities afore-
said, of justice of the peace and district judge of said
fourth election district.
