the owners of the lands over which they may locate said
road, taking into consideration the advantages as well as
the disadvantages that may result to said owners of
lands, and to cause the same to be surveyed, and the
plat thereof, together with the valuation of the damage
to the land-holders as aforesaid, and also an estimate of
the cost of constructing said road, and all other inciden-
tal expenses attending the executing of this act, and
shall make return thereof to the commissioners of Anne
Arundel county, and any person or persons, conceiving
him or themselves aggrieved by the proceedings and re-
turn of the said commissioners, may object to the ratifi-
cation thereof, before the said board of commissioners of
Anne Arundel county, and the said board of commis-
sioners are hereby required to exercise a sound discre-
tion in the premises, and when ratified and confirmed by
the board of commissioners as aforesaid, and not until
then, it shall be filed and recorded among the public re-
cords of Anne Arundel county.

CHAP. 524.

SEC 3. And be it enacted, That if the commission-
ers of Anne Arundel county, shall ratify and confirm
the proceedings and return of the commissioners ap-
pointed by this act, then after such ratification, and at
the time of making the county levy, they are hereby
authorised to levy upon the assessable property of Anne
Arundel county, a sum of money sufficient to defray all
expenses of locating, opening, and constructing said
road, and to pay the owners of the lands the damages
sustained by them respectively, according to the valua-
tion made by the said commissioners, and from and af-
ter said levy, the road that may be located as aforesaid,
shall be deemed and taken us a public road, and kept
in repair, as other public roads are, at the expense of the
county.

SEC. 4. And be it enacted, That the commission-
ers appointed by this act, before they proceed to the dis-
charge of their duties required of them, shall take and
subscribe an oath, that they will faithfully execute the
provisions of this act, without prejudice or partiality, and
shall give at least ten days notice, to the proprietors of
lands and others interested, by advertisement, set up at
the most public places in the neighborhood, of the time
and place of meeting, for the purpose of carrying the
provisions of this act into effect.

SEC. 5. And be it enacted, That all acts or parts of
acts repugnant to or inconsistent with the provisions of
this act, be and are hereby repealed.
