Be it enacted by the General Assembly of Maryland,
That Noble Pennington, formerly sheriff of Cecil coun-
ty, be and he is hereby authorised and empowered to
make his special return, and file it with the clerk of
Cecil county court, in the case of Mathew Newkirk, for
the use of George McCullough, against Stephen Hy-
jand, of St., being number fifty-nine, (fifty-nine,) on
the judicial docket of said court, for October term, one
thousand eight hundred and thirty-five, and that the
said special return, when so made, be deemed and ad-
judged as good and valid, to all intents and purposes,
both at law and in equity, as if it had been made and
filed at the said October term, eighteen hundred and
thirty-five, of said court, or within the time prescribed
by law for filing the same.

An act to repeal the act of eighteen, hundred and forty-
five, chapter two hundred and fifty four, so far as the
same relates to the Court of Appeals, for the Wes-
tern Shore.

Preamble.

WHEREAS, the said act of Assembly requires the clerk
of the said court to perform a duty which is substantially
performed and paid for under previous acts, and it is unne-
cessary that the same duty should be twice performed
and paid for — Therefore,
