CHAP. 71.

officers fees, public dues and county taxes and levies,
in the same manner as the said sheriff and collectors
were severally authorised to do whilst they were in of-

fice; provided, that if any person or persons, his, her or
their representatives, against whom any such fee, taxes
or levies may have been rendered, will make oath or
affirmation before a justice of the peace, that the same
has been paid or satisfied, then the aforegoing benefits
of this act shall not extend to such case or cases.

To be entitled
to credits, &c.

SEC. 2. And be it enacted, That the parties shall be
entitled under this act, to all credits, set off and dis-
counts, that they would have been entitled to during the
terms of said sheriffs and collectors.

In force.

SEC. 3. And be it enacted, That, this act shall
continue in force until the last day of December, eigh-
teen hundred and fifty-two.

CHAPTER 71.

An act to incorporate the Proprietors of Baltimore
Cemetery.

Preamble.

WHEREAS, public sentiment, in the city of Balti-
more, in accordance with the enlightened experience
of larger cities elsewhere, is opposed to the interment
of the dead amid the abodes of the living, for sanitary
and other obvious reasons; and whereas, experience
hath also shewn that it is desirable to have public
burial grounds, subject to such laws, rules, and regu-
lations as will insure to the living the continued pro-
tection of the remains of their dead, and the decent
preservation of the grounds by securing them in per-
petuity to the object of their dedication; and whereas,
several citizens of this State have purchased a tract
of land lying at the extreme limit of the north-eastern
part of the city of Baltimore, embracing about eighty
acres, and associated for the purpose of establishing
thereon a public cemetery, and for reasons above
stated, pray for an act of incorporation, and the object
being deemed worthy of encouragement — Therefore,

Incorporated.

SECTION 1. Be it enacted by the General Assembly
of Maryland, That Joseph Simms, Robert Haward,
J. S. Nicholas, John Murphy, Benjamin C. Barroll,
Thomas P. Chiffille, Joshua Vansant, Benjamin A.
Lavinder, B. C. Smith, and R. H. Evans, and their
