1849.

and managers shall either immediately after said
valuation pay the amount thereof to such owner or
owners, or to such persons as may be authorised by
him, her or them, to receive the same, or shall pay
the same immediately therefor, and they, are not
authorised to open said road until the payment
of the same, if application is made by and payment
withheld from such owner or .owners or authorised
agent, and if such owner or owners, be under any
legal disability, then the president and managers
shall enter into bond, conditioned for the payment of
the damages assessed to the person or persons who
may be duly authorised to receive the same, and shall
lodge said bond, in the office of the cleric of the
county aforesaid, to be by him recorded, and upon
such bond, or office copy thereof, suit or suits may
be instituted against the obligators therein named, by
any person or persons entitled to receive such dam-
age, and upon payment of the damages valued as
hereinbefore mentioned, or securing the payment of
the same, as provided for by this section, all the
fight, title, interest and estate of the owners thereof,
in and to the lands included in the plat hereinbefore
directed to he returned to the clerk of the county
court aforesaid, be and the same are hereby declared
to be vested in the company hereby incorporated, in
them and their successors in perpetuity, in full and
absolute estate and property, and the justice, sheriff
or jurors shall receive the same compensation for
services rendered under the provisions of this section,
as they are authorised to receive in similar cases, and
the clerk shall receive for recording each statement
and plat herein directed to be returned to and re-
corded by him, the same compensation as he would
be entitled to receive for recording any other instru-
ment of writing.

CHAP. 416.

SEC. 14. And be it enacted, That the county com-
missioners of Washington county, be and they are
hereby authorised to subscriber for such numbers
of shares, not exceeding two hundred, in the capital
stock of the company hereby incorporated, that they
may deem expedient and proper to be subscribed for
in the same, and for the benefit of Washington
county and to be represented at all meetings of
the stockholders of said company, by the county
commissioners, for the time being, or by such person
or persons as may be duly authorised by them, and
they are further authorised to levy on the taxable
properly of said county, such sum or sums of money
