CHAP. 391.

off, and locate a road, beginning at the southern point
of Doctor Benjamin Hood's farm, at the Old Freder-

ick road, and running thence north, on the division
line between the said Doctor Benjamin Hood and
John Hood, to the western extremity of Doctor B.
Hood's orchard, thence on the present road to a cor-
ner-stone planted in the division line between John
Hood and Doctor R. D. Hewitt, and thence on the
land of John Hood, as near as practicable to said di-
vision line to the southern terminus of Doctor R. D.
Hewitt's lane, then with said lane until it reaches the
land of Henry Forsyth, thence on the bed of an old,
load until it reaches the northwestern corner of Doc-
tor R. D. Hewitt's flat-field, and thence on the divis-
ion line between Doctor R. D. Hewitt and Upton D.
Welsh to the lane given by Doctor R. D. Hewilt to
Upton D. Welsh, and thence with said lane to the
blacksmith shop, on the Sykesville mill road.

Damages, etc.

SEC. 2. And be it enacted, That the said com-
missioners, or a majority of them, shall have power
to value and assess the damages sustained by the
owners of the lands over which they may locate said
road, taking into consideration the ad vantages as well
as the disadvantages that may result to the said own-
ers of lands, and to cause the same to be surveyed,
and a plat thereof, together with the valuation of the
damages to the landholders as aforesaid, and the ex-
pense attending the execution of this act, to be re-
turned to the commissioners of Howard district, and
any persons conceiving themselves aggrieved by the
proceeding and return to the said commissioners, may
object to the ratification thereof before the said board
of commissioners, and when ratified and confirmed
by the said commissioners, and not until then, it shall
be filed and recorded among the public records of the
district.

Expenses—
how paid.

SEC. 3. And be it enacted, That the said board of
commissioners shall after ratification, levy a sum or
sums of money, not exceeding one hundred and fifty
dollars, to defray all said expenses of locating and open-
ing said road, and to pay the owners of the lands the
damages sustained by them respectively, according to
the valuation made by said commissioners, and from and
after said levy, the road that may be located as aforesaid,
shall be deemed and taken as a public toad, and kept in
repair at the expense of the district.

To make oath.

SEC. 4. And be it enacted, That the commissioners
shall lake an oath, that they will faithfully execute the
provisions of this act, without partiality or prejudice, and
